GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale and the contractual relationships between Rica Spa and the Buyer are governed by Italian law. In the event of a dispute, before initiating any legal action, the parties undertake to seek an out-of-court settlement.

PURCHASE CONDITIONS

The Products and services we offer on the Site are reserved for persons who are:

  1. of legal age (or minors holding authorization from the person exercising parental responsibility allowing them to place an order on the Site);

  2. in possession of full legal capacity to place orders on the Site.

We reserve the right at any time to ask you for an identity document attesting to your age and/or said authorization. We reserve the right not to process a purchase order and/or to exclude from our customer/potential customer database any Buyer who has not responded to the aforementioned request or who has not complied with the principles set out in this clause.

USAGE LIMITATIONS AND QUANTITIES

Please note that the Products are intended solely for the Buyer's personal use. Purchase for professional purposes or for resale is strictly prohibited.

To this end, the Buyer must take particular care to ensure that the value of the Products purchased does not exceed the sum of Euro 600.00 (six hundred/00 euros) per purchase order.

In the event of an order exceeding said amount, the order will be considered null and void.

PRODUCTS – PRICES

  1. Products

The cosmetic products offered for sale on the Site, as well as any related accessory services and/or complementary products (hereinafter “Products”) are those present on the Site on the day of consultation and/or navigation on the same by the Buyer.

If a Product is unavailable, the Buyer is informed of such unavailability:

  • at the time of placing the order: a message appears indicating that the Product is temporarily unavailable, or

  • after validation of the order and before delivery, by email.

The Buyer is informed that the photographs and texts illustrating the Products are subject to variation.

  1. Prices

Prices are indicated in Euro (€) and are valid throughout the Italian territory.

Prices take into account any discounts and VAT applicable on the day the order is placed.

The prices indicated do not include processing and delivery costs, which will be invoiced in addition.

It is also specified that any promotions granted are valid exclusively for one order per user and for a specific period of validity and may not be combinable with other discounts.

The Seller reserves the right to modify prices at any time; however, Products are invoiced based on the rates in effect at the time the order is registered, subject to the availability of said products.

ORDER REGISTRATION AND VALIDATION

  1. How to place an order

To place an order, the Buyer must first connect to the Site.

Subsequently, the Buyer can learn more about the various Products offered for sale on the day of browsing the Site and choose the Products:

  1. by browsing the various Product categories, or

  2. by typing the name of the Product directly into the search engine

While browsing the Site, a Buyer who wishes to place an order may do so by simply clicking on the button intended to add the Product to the cart.

Once this operation has been performed, the Buyer will see the number of Products currently in their cart. We inform the Buyer that the contents of the cart may be subject to an expiration period.

The Buyer may continue browsing or click on the cart to verify its contents, viewing all order items, the essential characteristics of the Products, the total order amount, billing and delivery details, delivery times, costs and any delivery restrictions, as well as the legal rights and guarantees available to the Buyer.

The Buyer may return to their order, complete it, modify it, or cancel it if they have not yet validated it. If the Buyer wishes to choose other Products, they may continue browsing the Site, ensuring that the Product(s) they have selected are in their cart.

The Buyer has the option, at any moment during the processing of the order—that is, until actual payment under the conditions provided in these T&Cs—to return to their order, complete it, modify it, or cancel it as long as they have not yet actually validated it.

Once the selection of Products is complete, the Buyer can validate the order using the appropriate button. At that point, a new page will open, inviting the Buyer to:

  • provide a username (email address) and password if the Buyer is already registered on the Site, or continue as a guest,

  • accurately fill out a personal data collection form, in particular the mandatory fields (properly indicated) such as Surname, Name, Email address, Postal delivery address (i.e., the address to which delivery can be made during business hours from Monday to Friday);

  • Request an invoice, if necessary.

The Buyer undertakes to fill out the forms made available to them in good faith. The Buyer acknowledges that the data they communicate to the Seller and stored in the information systems of the Seller and/or their subcontractors is accurate and constitutes proof of their identity. Please be reminded that such personal data will be processed in compliance with the Privacy Policy accessible here.

After reviewing the order, the Buyer is invited to:

  • click the button that allows access to payment for the order, under the conditions described in these T&Cs, or

  • click the button that allows modifying the cart and/or the information relating to their personal data.

By clicking the button that allows access to payment for the order, the Buyer must mandatorily, in the first instance, review these T&Cs and subsequently confirm their consent to all the T&Cs by performing an acceptance confirmation action requested by the Site (such as, for example, checking a box).

As soon as the Buyer confirms acceptance of the T&Cs, an Internet page dedicated to payment for the order opens.

The Buyer must then proceed with payment for the order under the conditions described in these T&Cs.

The data recorded by the Seller constitutes proof of all transactions that have taken place between the Seller and the Buyer.

  1. Order confirmation

Once the order is confirmed and payment is validated, a printable and savable summary of the Buyer's order is displayed, showing the references of the purchase order itself.

The Seller will send, as soon as possible, an order confirmation email to the email address provided by the Buyer, with the following information:

  • – the identity of the Seller and their contact details,

  • – the order reference recorded when the order was placed,

  • – the order summary and the essential characteristics of the products,

  • – delivery times, costs and any delivery restrictions,

  • – the total order amount, including taxes,

  • – the legal rights and guarantees available to the Buyer,

  • – payment confirmation.

  1. Proof of order

By express agreement between the Seller and the Buyer, email messages shall serve as proof between the Parties, as shall the automatic recording systems used on the Site, particularly with regard to the type and date of the order.
